Qibi-Fresh Food at Work application and website

Introduction

Qibi SA (“Qibi”) creates a network of Qibi smart fridges (“Qibi Smart Fridges”) in private corporations in order to supply fresh food and beverages to the latter’s employees. These terms of use regulate the sale of Qibi products to the Customers ("you") as well as the handling of personal data.

Application of Terms and Conditions and Changes

Qibi enables you to purchase fresh food and beverages from its Qibi Smart Fridges, and provides its services through its mobile applications and related services (collectively, such services, including any new features and applications, and the Site, the "Service(s)"), subject to the following Terms and Conditions (as amended from time to time, these "Terms and Conditions").

The creation of your account and/or the use of any part of the Service at any time constitutes your consent to these Terms and Conditions.

We reserve the right, at our sole discretion, to change or modify portions of these Terms and Conditions at any time. If we do so, we will post the changes on this page and will indicate at the top of this page the date these terms were last revised. We may also notify you, either through the Services user interface, in an email notification or through other reasonable means. Any such changes will become effective no earlier than fourteen (14) days after they are posted, except that changes addressing new functions of the Services or changes made for legal reasons will be effective immediately. Your continued use of the Service or the non-deletion of your account after the date any such changes become effective constitutes your acceptance of the new Terms and Conditions.

In addition, you will be subject to any additional terms that may be posted on the Service from time to time, including, without limitation, the Privacy Policy and Terms of Service located at the Site.

Third party services

The app does use third party services that declare their own Terms and Conditions. You are accepting them by using the Qibi - Fresh Food at Work app.

ACCESS AND USE OF THE SERVICES

Services Description

The Service enables users to purchase fresh food and beverages from the Qibi Smart Fridges. You must create an online account with Qibi and purchase credits (which you have to top up by different means of payement) in order to make purchases of Products. Your wallet must > 0 CHF in order open a Qibi Smart Fridge. When an item is removed, the removal is registered by the Qibi proprietary system, which then automatically deducts the relevant number of credits from your account accordingly.

Registration Obligations

You are required to register with Qibi in order to access and use the Service. If you choose to use the Service, you agree to provide and maintain true, accurate, current and complete information about yourself. Registration data and certain other information about you are governed by our Privacy Policy. If you are under 18 years old, you may use the Service only with the approval of your parent or guardian.

Member Account, Password and Security

You are responsible for maintaining the confidentiality of your account user ID and password, and are fully responsible for any and all activities that occur under your account. You agree to (a) immediately notify Qibi of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session when accessing the Service. Qibi will not be liable for any loss or damage arising from your failure to comply with this Section.

Modifications to Service

Qibi reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Qibi will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

General Practices Regarding Use of Service and Storage of Data

You acknowledge that Qibi may establish general practices and limits concerning use of the Service, including without limitation the maximum period of time that data or other content will be retained by the Service and the maximum storage space that will be allotted on Qibi's servers on your behalf. You agree that Qibi has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded by the Service.

You acknowledge that Qibi reserves the right to terminate accounts that are inactive for a period of time of one (1) year. In this case, the balance of your wallet will be considered as spent and will not be refundable to you. You further acknowledge that Qibi reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

Mobile Services

The Service includes services that are available via a mobile device, including (i) the ability to browse the Service and the Site from a mobile device and (ii) the ability to access certain features through an application downloaded and installed on a mobile device (collectively, the "Mobile Services").

Food Allergens

Qibi and its Vendors cannot guarantee that the Products that are available for purchase via the Service are free of any and all traces of a particular allergen or that consumption of a Product will not result in an allergic reaction.

Expired Food: The Products will have a “sell by” date on the packaging. IF YOU CONSUME ANY PRODUCT THAT IS PAST ITS “SELL BY” DATE OR WHICH HAS EXPIRED, YOU DO SO ENTIRELY AT YOUR OWN RISK.
